Terms of service

These terms apply to businesses that use Local Data Hub Lead Intelligence ("Local Data Hub", "the service"), operated by The JM Marino Group ("we"). By signing in and using the service, you ("you", your business) agree to them.

1. The service

Local Data Hub helps you find homes in your service area that may need what you sell, write and mail letters to them, and see who responds by QR scan, call or call-back request. Features available to your account depend on your plan and any add-ons agreed with us.

2. Your account

Keep your login details private. You are responsible for what is done with your account and the logins on it.
Tell us promptly if you think someone else has used your account.

3. Using it lawfully and fairly

You are responsible for your marketing. In particular, you agree to:

follow every law that applies to your mail, calls and texts, including telemarketing, do-not-call and text-message consent rules, and to contact a homeowner who asked for a call back only about their request;
honor every request to stop mail. The service keeps a do-not-mail list for you and leaves those homes out of every send; do not work around it;
choose homes by facts about the property only. Do not use the service to target or exclude people because of race, color, religion, sex, disability, familial status, national origin or any other protected characteristic;
upload only addresses and information you have the right to use, and not use the service for anything misleading, harassing or unlawful.

4. Property information

Property facts come from public records and real-estate listing data. They can be incomplete, out of date or wrong, and we do not guarantee them. Letters are written so as not to claim that any home needs work; keep yours that way.

5. Letters written with AI

The service can draft each letter with AI from that home's facts and your offer. You review and approve what is sent: look at the sample letters before every send, and you are responsible for your letters' content and offers.

6. Mailing

Letters are printed and mailed by our mailing partner, Lob. Postage is charged as agreed with us, or by Lob directly when your account uses its own Lob key. A letter cannot be recalled once it has gone to print. Delivery times and outcomes are up to the postal service.

7. Fees

You pay the fees agreed with us for your plan, add-ons and any letters we cover. We may change fees with notice before your next billing period.

8. Your data

Your leads, lists, campaigns and responses belong to your business and are never shown to another business. Facts about a property itself are shared across the platform. Our privacy policy explains how we handle information.

9. Availability and liability

We work to keep the service running and your data safe, but it is provided "as is", without warranties of any kind, and we do not guarantee any number of responses or sales. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the fees you paid us in the three months before it arose.

10. Ending

You may stop using the service at any time. We may suspend or close an account that breaks these terms or goes unpaid. Letters already in the mail keep their QR codes working for a reasonable time.

11. Changes, law and contact

We may update these terms; the new version is posted here with a new date, and using the service afterwards means you accept it. These terms are governed by the laws of the State of Rhode Island. Questions: thejmmarinogroup@gmail.com.
